How much can your settlement be?

That depends on the circumstances of your case, including the extent of your injuries and who was at fault in the car crash. For cases involving amputation, paralysis, brain damage, burns or other severe injuries, payments can be substantially higher.

In a trial, payments can involve “compensatory” as well as “punitive” damages.

Compensatory damages are meant to repay or compensate you for actual damages or monetary losses from a traffic accident. That means you’ll be paid for your medical and hospital bills, for your lost present or future salary if your injury prevents you from working, and for your pain and suffering.

By contrast, punitive damages mean a defendant is punished to set an example. Such punitive or exemplary damages can be high, since they aren’t bound by the constraint of actual damages in a compensatory ruling. This way, especially bad drivers can be punished beyond the actual monetary losses.

In either case, attorney fees are limited to a pre-set portion of the settlement and are derived from that settlement. Attorney fees will not be paid out of your own pocket.
