Baby car seat failureCar accidents are the leading cause of death for children over one year of age, according to the Texas Children’s Center for Childhood Injury Prevention. Many of these are due directly to baby car seat failure , including defective design and poor resistance to wear and tear of every day life. The National Highway Traffic Safety Administration (NHTSA) lists hundreds of car seat models that have been recalled, or require additional “kits” that are supposed to fix the problem. This is a flawed process in itself. Often problems are identified months or even years before a formal recall is launched. During that time everyone with that defective seat is at risk of losing their child in an accident even if the car seat is properly anchored and the child secured. Defects are not detected through safety testing in the lab, they are discovered when an innocent victim is seriously injured or killed in a real-life situation. Even if the seats meet all safety testing standards, it does not mean that the seat is “safe.” A large portion of these deaths – about 40% – are a result of a side-impact accident. But because U.S. regulations do not require car seats to undergo side-impact testing, failure can occur in this common but unregulated situation. One key case in Mississippi in 2004 illustrates this point exactly. A single mother, relying on her safety-tested car seat, lost her son in a side-impact collision when the seat separated from the base. Weeks later, she found out that there had been several reports of her make and model of seat separating from its base before the accident she was involved in occurred. Yet a formal investigation didn’t start until after she lost her son. At the end of four months, the investigation still found that there was no need to recall… Car seats are spposed to be designed to protect our most precious cargo – our children. When manufacturers and regulations fail us, we are left to pick up the pieces ourselves. If your child has been injured or lost in a car accident due to car seat failure, you could be entitled to compensation to cover your short and long-term medical bills, as well as your pain and suffering.
