Class-action lawsuit sought for Vioxx deathThe wife of a Canadian resident who took the painkiller Vioxx is asking Quebec’s Superiour Court to authorize a class-action lawsuit against Merck & Co., Inc. A petition was filed on Monday, November 6, 2006 for a class-action lawsuit against Merck and its Canadian divisions on behalf of close relatives and spouses of former Vioxx users. Montreal resident Louis Hubert suffered two heart attacks in 2002, the petition says. He’d been taking Vioxx on a daily basis since October 2000. On Sept. 30, Merck withdrew Vioxx, (a nonsteroidal anti-inflammatory drug related to ibuprofen) after trial data showed the long-term use of the drug increased the heart attack and stroke risks in its users. On Nov. 9, 2006, Quebec Superior Court Judge André Denis authorized a class-action lawsuit on behalf of Quebecers who suffered “damages” from taking the drug between October 1999 and September 2004. |
