TRAFFIC NEWS: HEAVY RAINS CERTAIN, FLOODING POSSIBLE

Houston drivers are advised to avoid rising waters Wednesday as heavy rains enter the area and threaten to cause flooding on local roads.

On Wednesday the Houston area has a 100 per cent chance of receiving heavy thunderstorms,  according to weather forecasters.

Such forecasters are accustomed to calculating the weather as percentages and “chances,” but when it’s 100 per cent, then technically that’s not a chance but a certainty.

It will rain Wednesday — perhaps hard. Count on it.

Less certain but strong possibilities are gusty winds and thunder, along with some street flooding. There may even be isolated tornados.

Thunderstorms should reach the Gulf Coast by 2 a.m. Wednesday, while others should hover west of Houston later in the morning. Indeed, a “severe weather outlook” for a 23-county area including Harris County has been issued by the National Weather Service.

How much rain is expected? One to three inches are possible in many areas, and as much as five inches in spots where thunderstorms linger.

Obviously, flooding may be a problem. As always, drivers are advised not to venture out unless necessary, and not to drive into high or rising waters in hopes of passing through.

Texas attorney Jim Adler contributes to Lombardi Award’s cancer fight

Jim S. Adler, founder of Jim S. Adler & Associates, and son William Scott Adler, an attorney and member of the firm, joined the fight against cancer as part of this year’s 42nd Annual Rotary Lombardi Award presented to Boston College linebacker Luke Kuechly Wednesday night.

The firm’s $2,500 yearly sponsorship for Rotary Club of Houston’s event gives assistance to Texas Children’s Hospital Cancer Center, MD Anderson Children’s Cancer Hospital and the American Cancer Society.

“Bill and I share the Rotary Club of Houston’s passion for fighting cancer and compassion for the innocent children and others who suffer from the disease,” Jim Adler said. “We are thrilled that this prestigious event can do so much for such a worthy cause.”

The Rotary Lombardi Award was named after legendary Green Bay Packers coach Vince Lombardi, a two-time Super Bowl winner who died of cancer in 1970. Presented to Division IA college football’s best linebacker or offensive or defensive lineman as a trophy made of granite, it embodies Lombardi’s grit, determination and discipline and is the only award open to all college linemen.

Lombardi’s widow, Marie Lombardi, authorized the Rotary Club of Houston to launch the award in her late husband’s name soon after his death.

Also honored at this year’s presentation at Reliant Center was Jim Kelly, former quarterback of the University of Miami, the USFL’s Houston Gamblers and the NFL’s Buffalo Bills. Kelly received the Rotary Lombardi Humanitarian Award. A member of the Pro Football Hall of Fame, Kelly has championed the cause of disadvantaged and disabled children.

Others attending Wednesday night’s event were fellow finalists Courtney Upshaw, University of Alabama linebacker; Dont’a Hightower, University of Alabama linebacker; and Jonathan Martin, Stanford University offensive tackle, along with their respective coaches.

The award winner was chosen by a committee of 500 college football coaches, sports media personnel and former Rotary Lombardi Award winners and finalists. Twelve semifinalists were picked in late October, from which the four finalists were selected earlier this month.

Designed by Houston artist Mark Storm, the award consists of a 40-pound block of granite resting on a mounted silver pedestal.

Free legal advice: Stay off Facebook

Ask a lawyer about Facebook and you’ll probably get this reply: “Post a new comment about your accident and you’ll cause a legal nightmare.”

Here’s what lawyers fear: A client is in a bad car wreck. The client is still in a cast and can’t work. The client puts a quick post on Facebook to let friends know that he’s feeling better than he expected just three weeks after the accident. Now the insurance company is reducing the amount it will pay the client for his accident.

The Facebook post undercut his claim. The  client could end up paying some medical bills out of his own pocket and not getting as much for his lost wages, pain and suffering. (more…)

Best tips to win your case for food poisoning

EDITOR’S NOTE: The following is a guest blog post from the Bisnar Chase Law Firm of Orange County and Los Angeles, CA.

Unfortunately, the vast majority of people who get food poisoning don’t believe or know that they can do anything about it and can suffer horrific symptoms that may likely be the fault of the restaurant or food item provider. The truth is, food poisoning can become severe and lead to severe dehydration, bloody diarrhea, and death. The vast majority of consumers feel victimized and helpless when this happens, but justice can be done for you and also for many others to prevent the food producer to become responsible and expose unsafe or unsanitary practice. Wrongdoers need to be held accountable for these actions and a personal injury lawyer can help.

There are three points that must be proven in any state of the U.S. in order to make a successful claim:

Flesh eating bacteria in alcohol wipes

Deadly bacteria found in commonly used alcohol wipes and iodine pads triggered two nationwide recalls of the products after the death of a Houston toddler and the near death of a 10-year old boy in Colorado.

Millions of the contaminated wipes and pads could still be in home medicine cabinets. They have a long shelf life and were routinely sold at Walgreens, CVS Pharmacies, Safeway and Kroger and other stores – sometimes under private labels. The products are used to prevent infections after surgery and in cuts, scrapes and burns at home.

The recalls, one in January and another this month, include Triad baby wipes made by Triad Group Inc and iodine prep pads named Cardinal Health, Medical Specialties, VHA, Triad, Triad Plus, North Safety and Total Resources, made by H&P Industries Inc. According to MSNBC, H&P Industries does business as the Triad Group.

Auto recalls reveal dangers for drivers

Auto recalls are leaving drivers in the ditch when it comes to safety.

The latest involve Ford and Chrysler. They were announced on December 30, 2010. They affect 160,000 vehicles – 15,000 Ford trucks and crossover SUVs that have a glitch in their electrical systems that can start a fire and 145,000 Chrysler trucks and crossover wagons with steering, stalling and air bag concerns.

Last year may have set a record for recalls. They accelerated in late 2010 when at least one million cars were recalled during October and November for potentially dangerous defects. The ten automakers involved in those recalls were known for some of the most reliable cars on the road,  according to the New York Times and The Wall Street Journal. They included BMW, Tesla, Mercedes-Benz, Volvo, Nissan, General Motors, Aston Martin, Isuzu, Hyundai and Nissan.

FEDs most wanted list

Admit it! You always suspected that the federal government had a “most wanted” list. And yes, it does exist. But it may surprise you.

It’s a list of the “Most Wanted Transportation Safety Improvements,” not the 10 most wanted list you were probably thinking of. It’s aimed at stopping one of the biggest killer of kids today – distracted driving – the texting and talking on cell phones that is driving up the death rate on American roads for teenagers.

The National Transportation Safety Board (NTSB) created its “most wanted” list in 1993 when it began urging states to reduce the death rate among young drivers and their passengers. by putting restrictions on novice drivers. The agency calls the changes that resulted “the most significant alteration of young driver practices in 50 years.”  But work remains.

Lawyer wins $1.275 million for Florida accident victim

The crash that could have killed Juan Allen Walker was violent.

In his dreams, the accident ends with his death. His wife dies too. In reality, Walker had seconds to shove her onto the floorboard of his Ford 350 pick-up to save her, before he took the full impact of the road traffic accident that changed his life forever.

An astute, hard-fighting injury attorney in Florida named Ed O’Hara took Walker’s case and won the million dollar settlement that Walker deserved, despite counter charges that the injured man was a malingerer.

On October 29, 2010, a Lee County, Florida jury deliberated just one hour before awarding the permanently injured bee keeper $1.275 million in the injury accident.
