Our Client Reviews

For decades, women have used Johnson & Johnson’s talcum powder products on themselves and their children. All of that started to change when a woman named Deane Berg brought a talcum powder lawsuit against Johnson & Johnson in 2014. Berg was diagnosed with ovarian cancer in 2006, and she later discovered that the condition was caused by the talcum powder she has used for years. Berg’s claim turned out to be the first ovarian cancer lawsuit of many, and awareness of this issue has only grown since a February 2016 ruling that Johnson & Johnson must pay $72 million to settle a Missouri ovarian cancer case.

Baby Powder Class-Action Suits

Mona Estrada filed a class-action ovarian cancer lawsuit in a California court when she realized that she also had the basis for a talcum powder lawsuit. Estrada’s attorney pointed out that Johnson & Johnson never put a warning label on their products warning against the possibility of ovarian cancer. When the claim was filed, it cited Berg’s case as a precedent.

After a case review of both Berg’s claim and Estrada’s, Barbara Mihalich introduced her own Johnson & Johnson baby powder lawsuit, and the cases started to pile up from there. The biggest blow to the company so far, however, came in the form of a lawsuit filed by the family of Jacqueline Fox, a Missouri woman who died of ovarian cancer after using talc-based products for decades. The jury ruled that the company failed to warn people that its products could cause cancer, paving the way for others to step up and take action against Johnson & Johnson.

Johnson & Johnson Tied to Ovarian Cancer

But why are so many women convinced that they have a legitimate talcum powder ovarian cancer lawsuit on their hands? The story of how Johnson & Johnson’s products became associated with ovarian cancer is one that women from all over the world should listen to carefully.

Berg was a professional physician’s assistant, which made her feel confident in her ability to avoid products that would do her harm. So when she discovered that there had been studies linking talcum powder to ovarian cancer since at least the early 1980s, she was shocked. These same studies also showed that talcum powder was dangerous for children. But when Berg dug deeper, she was shocked to find that there was a secondary scientific basis for these studies that almost no one knew about.

In 1976, a study was done on various types of talcum powder at Mount Sinai Hospital in New York City that revealed that talcum powder contained high concentrations of two different types of asbestos fibers. These types of fibers have been known to cause cancer, which directly linked Johnson & Johnson’s products to the potential for causing cancer. Since women sometimes apply the powder to their genital area to help reduce perspiration and odor, the connection for a talcum powder cancer lawsuit was easy to make. Companies have since been ordered to remove asbestos from talcum powder, but cases of ovarian cancer after its use continue to add up.

No Warning Labels

Even with all of the evidence against Johnson & Johnson, the company still could have averted some culpability by taking simple steps that it never took. All of the studies regarding talcum powder’s dangers were buried in the pages of various medical magazines that a vast majority of people do not read. However, lawyers and doctors read these types of articles, and so do medical consultants to large corporations. To avoid losing any potential talcum powder and ovarian cancer lawsuit, all Johnson & Johnson had to do was put a warning on its products. Since the company did not publish any warnings or do the morally responsible thing and pull the products from store shelves, the company opened itself up to a string of costly lawsuits that could go on for decades.
