Train accidents are not as frequent today as they were in decades past, but they still lead to unacceptable fatalities and injuries across the United States. Just recently, a commuter train in Los Angeles slammed head-on into a freight train, killing 25 persons and severely injuring many more.

In fact, on an average of every 90 minutes, a train accident occurs in the U.S.

Many of these accidents are preventable, often simply by properly maintaining a railroad track. Other mistakes which are made by a railroad line can lead to devastating accidents involving injuries or death.

A train accident lawyer can help

If you or a loved one has suffered in a train accident, a train accident lawyer can help. Such a lawyer is keenly aware of rules and regulations involving railroads and trains, as well as the Accident Prevention Division that performs research for the Federal Railroad Administration (FRA). These lawyers know of trouble spots which can make a train or a railway unsafe.

A train accident lawyer will search the site of an accident for any type of clue as to its cause. Such a lawyer will examine train signal systems and check to see that the train was able to reveal itself via warning systems.

Recently the FRA sponsored a comprehensive workshop which is mentioned in the U.S. Department of Transportation Highway-Rail Crossing Safety Action Plan. This workshop proposed new initiatives to reduce railroad damage.

Evidence aids a train accident lawyer

A train accident lawyer should be aware of these initiatives and can determine if the train accident was caused as a result of failure to implement such innovations. If this is the case, the lawyer has even more evidence on his or her side in court.

The laws of an individual state can govern whether the railroad carrier is responsible for causing injuries or damages. Many factors can show that railroad companies were at fault. If a railroad carrier is at fault, the legal process then becomes a matter of determining the extent of its liability.

A train accident attorney with Jim S. Adler & Associates can take everything into consideration and determine the likelihood that a court will hold a railroad responsible for an accident, and how much compensation it might be forced to pay. All safety measures required by the federal government must be met. If the railroad company fails to do so, it becomes liable for the accident.

Every railroad company must be up to the mark when it comes to safety procedures. Any company that does not meet safety standards must face financial and judicial consequences. A train accident lawyer can fight for your right to the compensation you deserve. Find out more at the law firm's News and Views blog, then contact a train accident lawyer at Jim S. Railroads can do harm to workers

A four-part series that ran in the Louisville, KY Courier-Journal uncovered a growing epidemic of cases of toxic encephalopathy among railroad workers. The report found that over 600 workers displayed the symptoms of degenerative brain disease. But because of the difficulty to diagnose, its similarities to other diseases like Alzheimer’s, and its relatively unknown profile even in the medical community, it is feared that thousands more have developed it over the years.
